ARK LEVER LIMITED WARRANTY

ONE YEAR LIMITED WARRANTY

Ark Lever (“Company”) warrants to the original purchaser that the Ark Lever fitness device will be free from defects in materials and workmanship under normal use and conditions for a period of one (1) year from the date of original purchase (“Warranty Period”).

WHAT THIS WARRANTY COVERS

This warranty covers manufacturing defects in the structural components of the Ark Lever, including but not limited to:

• Welds and frame components

• The BV/BH joint connection hardware supplied with the unit

• Loading pin and hitch pin

• Foot plate and brackets

WHAT THIS WARRANTY DOES NOT COVER

This warranty does not cover, and the Company expressly disclaims any responsibility for:

1. Wear items — Including but not limited to rubber grips, rubber tread on pivot bases, and any foam or padded components. These items are subject to normal wear and are not covered under any warranty.

2. Improper assembly — Any damage or failure resulting from failure to follow the included assembly instructions, including failure to apply thread locker to bolts as specified in the assembly instructions or video.

3. Misuse or overloading — Any damage or failure resulting from use beyond the stated maximum recommended load of 90 lbs (two standard 45 lb plates), use for purposes other than intended, or use in a manner inconsistent with the assembly and use instructions.

4. Normal wear and tear — Gradual deterioration from regular use is not a manufacturing defect and is not covered.

5. Damage from accidents, negligence, or modification — Including any alteration, modification, or repair of the unit by anyone other than the Company.

6. Cosmetic damage — Scratches, dents, fading, or other cosmetic imperfections that do not affect the structural function of the unit.

7. Failure to maintain the unit — Including failure to periodically inspect and re-torque bolts as recommended in the maintenance instructions.

HOW TO MAKE A WARRANTY CLAIM

To make a warranty claim within the Warranty Period, the original purchaser must:

1. Contact Ark Lever at thearklever@gmail.com within the Warranty Period

2. Provide proof of purchase (order number or receipt)

3. Provide a description and photographic evidence of the defect

4. Ship the defective component(s) to the Company if requested, at the Company's expense for valid warranty claims

REMEDY

At the sole discretion of Ark Lever, the Company will either:

• Replace the defective component(s) or the entire unit, or

• Issue a full or partial refund of the original purchase price

The Company reserves the right to determine the appropriate remedy based on the nature of the defect, availability of replacement parts or units, and other relevant factors. The remedy provided under this warranty is the purchaser's sole and exclusive remedy for any defect covered by this warranty.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR INDIRECT DAMAGES OF ANY KIND ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF USE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

GENERAL

This warranty gives you specific legal rights. You may also have other rights which vary by state or jurisdiction. Some states do not allow limitations on implied warranties or exclusion of incidental or consequential damages, so the above limitations may not apply to you.

This warranty is non-transferable and applies to the original purchaser only. It is void if the product is resold or transferred to a second owner.
